On 5th July 2006, His Excellency Shaikh Ahmed bin Mohammed Al-Khalifa, Minister of Finance, issued Ministerial Order No. 4 for the year 2006 with respect to banning the export of subsidized petroleum products. The Order provides as follows:
“The Minister of Finance;
In pursuance of Decree-Law No. (14) for the year 1987 in respect of the Ships Registration Law and Safety Regulations;
In pursuance of the GCC Unified Customs Law (Regulations), promulgated by Decree-Law No. (10) for the year 2002, and of Article (24) thereof, in particular; and the Implementation Regulations of the GCC Unified Customs Law (Regulations), promulgated by Ministerial Order No. (3) for the year 2003; In pursuance of Minister of Finance & National Economy’s Order No. (7) for the year 2003 with respect to the Rules of Investigation of Smuggling within and outside the Customs jurisdiction; In pursuance of Prime Ministerial Edict No. (11-1877) issued on 2nd April 2006 with respect to Banning any Subsidized Commodity;
In pursuance of NOGA Chairman’s Letter No. NOGA/347/2006 dated 4th June 2006 in respect of
Banning Petroleum Products as part of the Subsidized Commodities;
Has Ordered as Follows:
Article 1
No subsidized petroleum products listed in the attachment hereto may be exported. This ban shall not apply to the petroleum products of the Bahrain Petroleum Company (Bapco).
Article 2
No used oil, lubricants or greases may be exported without the consent in writing of NOGA.
Article 3
The General Directorate of Customs in cooperation and coordination with NOGA and other authorities concerned shall prevent and seize any customs smuggling operations of subsidized petroleum products under the provisions set forth in the Unified Customs Law and Ministerial Order No. (7) for the year 2003 referred to above.
Article 4
Proper seizure records must be made for customs smuggling operations of subsidized petroleum
products. All those involved in such operations must be referred to the judicial authorities for breaching the provisions of the Unified Customs Law.
Article 5
The General Directorate of Ports, within the jurisdictions provided for by the relevant laws, shall observe the ships at ports or anchoring within the territorial waters of the Kingdom to report any ship suspected of carrying subsidized petroleum products for exportation.
Article 6
The President of Customs, Ports & Free Zones shall implement this Order, which shall come into force as from the date of issue and be published in the Official Gazette.
